The Special Prosecutor, Kissi Agyebeng, has updated the Accra High Court on the status of the SML/GRA revenue assurance scandal, confirming that the Republic is currently navigating two significant legal tracks in the United States to secure the return of the primary accused persons.
Former Finance Minister Ken Ofori-Atta (A1) and his former Chef de Cabinet, Ernest Darko Akore (A2), are both currently in the U.S., where they face 78 counts of corruption, conspiracy, and causing financial loss to the state.
Status of U.S. Legal Proceedings
The Office of the Special Prosecutor (OSP) is awaiting the outcome of two distinct but related international legal actions:
Extradition Proceedings: Following the formal submission of an extradition packet by the Attorney-General to the U.S. Government in December 2025, judicial processes are now underway to transfer both men to Ghana for trial.
U.S. Custody (Ken Ofori-Atta): The OSP confirmed that Ken Ofori-Atta was arrested by U.S. authorities in Washington, D.C., on January 6, 2026.
INTERPOL and The "Red Notice" Controversy
The OSP’s efforts encountered a procedural hurdle in early February 2026 regarding the INTERPOL Red Notice:
The CCF Ruling: On February 14, 2026, the Commission for the Control of INTERPOL’s Files (CCF) ruled that the Red Notice for Mr. Ofori-Atta was "no longer necessary" because he had already been apprehended by the U.S. government.
Termination of Status: While this terminated his "wanted" status on the public INTERPOL platform, the OSP clarifies that this has no impact on the separate extradition proceedings, which continue independently of INTERPOL channels.
